Erath County officials have issued a 90-day burn ban, effective immediately, due to the increased risk of wildfire across the region. The order will remain in place from 9:00 a.m. on September 22, 2025, through 8:00 a.m. on December 21, 2025.

The declaration, made under the Texas Disaster Act of 1975, prohibits all outdoor burning in unincorporated areas of the county. This includes brush piles, trash burning, and any other open flames.

🔧 Welding and Cutting Exceptions

Welding, cutting, or grinding in the field is allowed only under strict safety requirements:

  • Work areas must be cleared of vegetation within 25 feet.

  • Ground must be wetted down before work begins.

  • A fire watch with water and extinguishers must be present.

  • Wind speeds must be below 20 mph (30 mph if using an enclosed welding box).

  • At least 25 gallons of water must be on site, and emergency communication must be available.

👮 Enforcement & Penalties

  • Fire departments will respond to any reported burning.

  • Peace officers and fire officials may issue warnings for first-time violations.

  • Repeat or flagrant violations may be prosecuted.

  • Violations are classified as a Class C Misdemeanor, punishable by a fine of up to $500.

Officials urge residents to take the order seriously. The Erath County Fire Marshal’s Office says on their website:

“It is the mission of the Erath County Fire Marshal’s Office to prevent and/or reduce the incident of fire by increasing the awareness and knowledge of the residents and businesses respecting fire safety in Erath County.”

The order applies to all unincorporated areas of Erath County and will remain in effect unless lifted earlier by the Commissioners Court.

For questions or updates, residents are encouraged to check with Erath County Emergency Management or their local fire departments.
